Flog It Terms & Conditions

1. About These Terms

These Terms & Conditions (“Terms”) apply to the Flog It service provided by Motorflog (“Website”).

The Website is operated by Motorflog Ltd (“Motorflog”, “we”, “us”, “our”).

By submitting a vehicle through Flog It, you confirm that:

• You have read and understood these Terms
• You agree to be bound by them

2. Nature of the Service

Flog It is a service where:

• Motorflog acts as an agent on your behalf
• Your vehicle is entered into a trade auction environment

Motorflog:

• Does not guarantee a sale
• Does not act as the buyer (unless agreed separately)

3. Eligibility & Seller Requirements

By submitting a vehicle, you confirm that:

• You are legally entitled to sell the vehicle
• You are at least 18 years old
• All information provided is true, accurate, and complete

You must provide:

• Valid photographic ID (passport or driving licence)
• Vehicle logbook (V5C), regardless of whose name it is in
• Accurate vehicle details
• Bank details for payment

Where applicable:

• If the vehicle is not registered in your name, you must provide supporting proof of ownership (such as a purchase receipt)
• Where a logbook is unavailable, sufficient proof of ownership must be provided

We reserve the right to:

• Request further documentation
• Refuse or remove any listing
• Delay or withhold progression where verification is incomplete or unsatisfactory

4. Flog It Fee

• A fixed fee of £49 (including VAT) applies
• This fee is:
  • Payable upon submission
  • Non-refundable

The fee covers:

• Entry into up to 3 auction cycles

5. Auction Process

• You set a reserve price for your vehicle
• Your vehicle will be listed in a trade auction environment

You acknowledge that:

• A vehicle may be marked as “sold” at auction where bidding concludes
• However, a sale is only considered complete once the buyer has made full payment
• Sale is not guaranteed

6. Vehicle Collection or Delivery

Before a vehicle can be entered into auction:

• The vehicle must be in the possession of Motorflog

This will be arranged by either:

• Seller drop-off to the Motorflog site, or
• Collection arranged with Motorflog

We reserve the right to:

• Refuse to list any vehicle that has not been received into our possession
• Delay auction entry until the vehicle has been received and processed

7. If Your Vehicle Does Not Sell

If your vehicle does not sell after 3 auction cycles, you may:

• Collect your vehicle, or
• Pay a further £49 to enter an additional 3 auction cycles

8. Failed Buyer Payment

If a buyer fails to complete payment after winning an auction:

• The sale will not be treated as complete
• Your vehicle may be re-entered into auction
• This will not count as one of your allocated auction cycles

You will be provided with an additional auction opportunity at no extra cost.

9. Withdrawal of Vehicle

You may withdraw your vehicle:

• Before it is listed, or
• Between auction cycles

However:

• The £49 fee remains non-refundable

You cannot withdraw:

• While the vehicle is actively listed in a live auction cycle

10. Sale Completion & Seller Obligation

If your vehicle is sold at auction:

• A binding sale is formed when:
  • Bidding meets or exceeds your reserve price, and
  • The buyer has completed full payment

Once this occurs:

• The sale is final and cannot be cancelled or reversed
• You are not permitted to withdraw the vehicle
• You are legally obliged to complete the sale

Motorflog will:

• Manage the process

11. Payment to Seller

Payment will be made to your nominated bank account once:

• The vehicle has been sold through the auction and the buyer has completed payment, and
• All necessary documentation has been verified

If a buyer fails to complete payment:

• The sale will not be treated as complete
• Your vehicle may be re-entered into auction
• This will not count as one of your allocated auction cycles, and you will be provided with an additional auction opportunity

We reserve the right to:

• Delay payment where verification is incomplete
• Adjust timelines where issues arise

12. Vehicle Information & Accuracy

You are responsible for:

• Accurately describing the vehicle
• Disclosing all known faults

Failure to do so may result in:

• Sale cancellation
• Claims from buyers
• Recovery of losses from you

13. No Guarantee of Sale Price

Motorflog does not guarantee:

• That your vehicle will sell
• That your reserve price will be met

However:

• Your vehicle will not be sold below the reserve price you have set

You accept that:

• A sale will only occur where bidding meets or exceeds your reserve
• Market demand ultimately determines whether a sale takes place

14. Collection & Storage

If your vehicle is unsold:

• You have 4 days free storage, starting the day after the final auction cycle

After this:

• Storage charges apply at £15 + VAT (£18) per day

You are responsible for:

• Arranging collection of your vehicle

15. Liability

Nothing in these Terms excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation

Subject to this:

• We are not liable for indirect or consequential losses

16. Breach of Terms

If you breach these Terms, we may:

Remove your listing
• Withhold services
• Recover any losses incurred

17. Governing Law

These Terms are governed by the laws of England and Wales.
