Buy It Now Terms and Conditions

1. About These Terms

These Terms & Conditions (“Terms”) apply to all vehicles purchased through the Buy It Nowservice on the Motorflog website (“Website”).

The Website is operated by Motorflog Ltd (“Motorflog”, “we”, “us”, “our”).

By purchasing a vehicle through Buy It Now, you confirm that you:

  • Have read and understood these Terms
  • Agree to be bound by them

2. Trade-Only Sales

All vehicles sold via Buy It Now are strictly for trade users only.

By purchasing a vehicle, you confirm that:

  • You are acting in the course of a business or trade
  • You are not acting as a consumer

You acknowledge that:

  • Consumer protection laws (including cancellation rights) do not apply
  • No cooling-off period is offered

We rely on this declaration. If it is found to be false, we reserve the right to:

  • Cancel access to our services
  • Recover any losses incurred

3. Vehicle Listings & Information

Vehicles listed on the Website:

  • Are typically trade vehicles
  • May require minor or major repairs
  • May include salvage or non-retail stock

We:

  • Provide details of known issues only
  • Supply images to support listings

However:

  • Information may not be exhaustive
  • Additional faults may be present

You agree that:

  • You are purchasing based on your own judgment
  • You do not rely solely on descriptions, images, or listings

4. No Viewings

Vehicles are not available for viewing prior to purchase.

All purchases are made based on the information provided within the listing.

5. Pricing & Fees

The price displayed for a vehicle:

  • Does not include buyer fees, unless stated otherwise

The following fees apply:

  • Item Admin Fee: £120 + VAT
  • Final Price Fee: Variable depending on vehicle price

All fees:

  • Are subject to VAT
  • Will be clearly displayed before payment

Some vehicles may be subject to VAT. This will be clearly indicated in the listing.

6. Reservation & Payment

When you add a vehicle to your basket:

  • It is reserved for 15 minutes only

Payment must be made:

  • Immediately at checkout

We accept payment via Open Banking through Wonderful.

Failure to complete payment within the reservation window may result in:

  • The vehicle being released for sale

7. Formation of Contract

A legally binding contract is formed when:

  • Full payment has been successfully received

Once payment is made:

  • The sale is final
  • No cancellations or changes are permitted

8. Ownership & Risk

  • of the vehicle is transferred once payment has been processed and confirmed by us
  • This process may take between 10 minutes and 48 hours, depending on timing
  • in the vehicle (including damage or loss) transfers upon collection

9. Collection of Vehicles

Buyers are responsible for arranging collection via our Website booking system.

You will receive instructions on how to book collection after purchase.>

Collection Timeframe

  • Buyers receive 4 days free storage, starting the day after purchase
  • Vehicles must be collected within this period

Storage Fees

Failure to collect within the free period will result in:

  • Storage charges of £15 + VAT (£18) per day

10. Failure to Collect

If a vehicle is not collected:

  • Storage charges will continue to accrue daily
  • Where storage charges exceed the value of the vehicle, we reserve the right to:
    • Resell the vehicle
    • Recover outstanding costs

You remain liable for any shortfall where applicable.

11. Condition of Vehicles

All vehicles are sold:

  • As seen
  • Without warranty
  • With no guarantee of condition

You accept that:

  • Vehicles may have undisclosed faults
  • Repairs may be required

This is a trade-to-trade sale, and pricing reflects this.

12. No Cancellations, Refunds or Returns

All sales are final.

We do not offer:

  • Cancellations
  • Refunds
  • Returns
  • Cooling-off periods

13. Limitation of Liability

Nothing in these Terms limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation

Subject to this:

  • We are not liable for indirect or consequential losses
  • Our total liability shall not exceed the purchase price of the vehicle

14. Buyer Responsibility

You agree to:

  • Provide accurate information
  • Complete payment promptly
  • Arrange collection within the stated timeframe

15. Breach of Terms

If you breach these Terms, we reserve the right to:

  • Suspend or terminate your account
  • Restrict future access
  • Recover any losses incurred

16. Governing Law

These Terms are governed by the laws of England and Wales.
